1. Introduction

Welcome to Aster Landscaping & Construction Ltd., operating in Edmonton, Alberta, Canada. These Terms & Conditions govern your use of our website and services. By accessing our website or hiring our services, you agree to these Terms effective immediately..

2. Services

We provide residential and commercial construction and landscaping services, including but not limited to:

• Landscaping design and installation
• Hardscaping (patios, retaining walls, stonework)
• Lawn installation and grading
• Decks, fences, and outdoor structures
• Renovations and general construction

All services are subject to a written estimate and signed contract.

3. Estimates & Quotations

• All quotes are valid for  30 days unless otherwise stated.
• Prices may change if project scope changes.
• Additional work requested after project start may result in additional charges.
• Final pricing will be outlined in a signed agreement.

• Verbal changes are not binding.

4. Deposits & Payment Terms

• A deposit (typically 20%–50%) will be required before work begins.
• Progress payments will be required timely as discussed.
• Final payment is due upon substantial completion.
• Late payments may incur interest charges as permitted under Alberta law.
• The Company reserves the right to suspend work for non-payment.

5. Builders’ Lien Notice (Alberta)

Under the Builders' Lien Act (Alberta), the Company may register a lien against the property for unpaid work or materials supplied.

Failure to make payment may result in lien registration within the time period allowed by Alberta law.

6. Permits & Compliance

• Required permits may be obtained by the Company or the Client as outlined in the contract.
• The Client is responsible for compliance with City of Edmonton bylaws unless otherwise agreed in writing.
• Delays due to permit approval or inspection are not the Company’s responsibility.

7. Weather & Seasonal Delays

Due to Alberta’s climate, landscaping and construction work may be delayed due to:

• Rain, snow, or extreme temperatures
• Ground frost conditions
• Material supply shortages

Such delays do not constitute breach of contract.

8. Client Responsibilities

The Client agrees to:

• Provide clear access to the worksite
• Remove personal items from the project area
• Ensure property lines are clearly identified
• Inform the Company of underground utilities (utility locates are mandatory before digging)apply the markings on click before you dig

9. Warranties

• Workmanship warranty: 1 year, unless otherwise stated
• Manufacturer warranties apply to materials only
• Warranty excludes damage from misuse, neglect, improper maintenance, natural settlement, or extreme weather

10. Limitation of Liability

To the fullest extent permitted under Alberta law:

• The Company is not liable for indirect or consequential damages
• Total liability shall not exceed the total contract price paid

11. Website Use

By using our website, you agree not to:

• Use it unlawfully
• Attempt to interfere with website security
• Copy content without permission

All content is the intellectual property of our Company

 

15. Amendments

We reserve the right to modify these Terms at any time. Updated versions will be posted on our website.
